Abstract

The concept of judicial proof in Iraq dates back to ancient times; under the Code of Hammurabi, specifically, judicial evidence took various forms—including writing, testimony, oaths, and admissions. The Code dedicated numerous articles to evidentiary matters; for instance, Articles 20, 23, and 133 addressed oaths, which were resorted to only in the absence of other legal evidence.

As for Islamic Sharia, it has attached great importance to the rules of evidence. Both the Holy Quran and the noble Prophetic Sunnah have given significant attention to this subject, as evidenced by the numerous references to methods of proof found therein; notably, God Almighty commanded that the party against whom a right is claimed must acknowledge it in writing.

Regarding Iraqi law, Civil Law No. 40 of 1951 regulated the substantive rules of evidence in Articles 444 through 505, while Articles 98 through 140 of the Civil Procedure Law No. 83 of 1969 governed the procedural (formal) rules. Additionally, Articles 37, 38, 41, 103, 104, 105, 106, 107, and 564 of the Commercial Law No. 149 of 1970 regulated evidentiary provisions in commercial matters.

An admission is considered strong evidence that leads to the factual truth—an undeniable reality that leaves no room for refutation. Consequently, the person making the admission is legally bound to accept responsibility and the resulting obligations, and must fulfill the matter admitted. A formal admission (*iqrar*) is a method of proof that is binding upon the civil judge; it constitutes conclusive evidence in itself, requiring no corroboration, and serves to streamline litigation proceedings and expedite their resolution. It is regarded as the paramount form of evidence—possessing the greatest probative force and certainty—because it is directly linked to the truth, originating from the very person involved in the matter. Consequently, the likelihood of veracity is extremely high, as it is inconceivable that an individual would voluntarily admit to something that unjustly divests them of ownership. Such an admission obliges the declarant to relinquish control over the subject matter to their adversary and commit to its delivery, thereby demonstrating an intent not to contest the claim—a stance that effectively guarantees the judicial oversight of the admission. Formal admission offers numerous advantages, most notably ensuring that rights are restored to their rightful owners for their benefit. It serves as absolute proof regarding rights, funds, and property, regardless of value; once made with all its requisite elements fulfilled, it is self-binding and cannot be retracted.

This significant role of formal admission among the evidentiary methods prescribed by the prevailing Law of Evidence prompted us to select it as the subject of this study. We aim to examine its nature, analyze its characteristics, and highlight its importance relative to other methods of proof.

To comprehensively address this topic, we have structured the research into four sections: the first is dedicated to the concept and characteristics of formal admission; the second examines the conditions required for a valid admission; the third discusses the various types of admission; and the fourth addresses the issue of inconsistency within an admission. We conclude this modest study with a summary of the topic and an overview of our key findings and recommendations.
